Who you are contracting with
The software and this website are provided by MyPrentice CommV, registered in Belgium under enterprise number 1010.664.279 (VAT BE 1010.664.279), with its registered office at Groenstraat 82B, 2440 Geel, Belgium. "We" and "us" below mean MyPrentice CommV. "You" means whoever is using the software, whether that is you personally or the organisation you are buying on behalf of.
These terms cover every product we sell. Where a particular product works in a way that affects what you are agreeing to, that is set out in its own documentation, and those pages form part of these terms.
What you are buying
You are buying a licence to use software, not the software itself. Nothing here transfers ownership, source code, or any right to create derivative works.
A licence lasts for the period you paid for and covers the scope stated when you bought it — an organisation, a tenant, an installation, or whatever unit that product is licensed by. The product's pricing page says which. Cover a second one and you need a second licence.
Licences are not transferable between organisations without our agreement. If your company is acquired or restructured, get in touch and we will sort it out; we are not in the business of making that awkward.
Free tiers
Some of our products have a free tier. Where they do, it is a real tier and not a trial: no time limit, no card, and no automatic conversion to a paid plan. We may change what a free tier includes for new users, but we will not quietly reduce it underneath an organisation already relying on it.
Payment
Orders and payments are handled by Paddle, who act as merchant of record and seller of record. Paddle takes the payment, works out the VAT and issues the invoice. Your card details go to Paddle and never reach us. Paddle's own buyer terms apply to the payment alongside these terms.
Whether prices are shown with or without VAT depends on where you are and whether you supply a valid VAT number, which Paddle determines at checkout. Annual plans bill once a year, monthly plans monthly, and both renew until you cancel.
Refunds
Every purchase carries a 30-day money-back guarantee, running from order completion. The refund policy sets out how to ask for one and what happens to your licence afterwards.
Support
Support is by email at support@myprentice.be. Organisations on a paid licence get a first response within two business days. Free-tier questions are answered when we can, usually quickly, but without a committed time.
Bugs and feature requests go to the same address. There is no public tracker yet; when there is one, it will be linked here.
What you may not do
Do not resell, sublicense or redistribute our software. Do not remove or work around its licence checks. Do not reverse engineer it, except where the law says you may regardless of what a contract states. Sharing a licence key outside the organisation it was issued to is a breach of these terms and will get the key revoked.
What we promise, and what we do not
We take care that our software behaves the way its documentation says it does, and we fix things that do not. We cannot promise it is free of defects or that it will never be interrupted, and beyond the warranties Belgian law does not let us exclude, it is provided as it is.
Our software runs inside systems you control and acts on data you already hold. You are responsible for the configuration you give it and for what that configuration does. Where a product offers a preview or a dry run, use it before applying anything widely.
So far as the law allows, our total liability for any claim about the software is capped at what you paid us for it in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost profit or lost data. None of that limits liability for fraud, for death or personal injury, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are untouched by any of this.
If a licence lapses
We do not delete or alter data our software has already written for you. Whatever it produced while licensed stays where it is. The software stops doing new work and says so clearly, and renewing starts it again without reconfiguration.
Your data
Our software does not send your data to us or anyone else. What little personal data we handle, and why, is in the privacy policy.
Changes to these terms
We may update these terms; the date at the top shows when we last did. Changes are not retroactive. If a change materially reduces what you get during a term you have already paid for, it does not apply to you until your next renewal.
Governing law
Belgian law applies and the Belgian courts have jurisdiction. If you are a consumer living elsewhere in the EU, that does not deprive you of the protection your own country's mandatory rules give you.
